If you provide us with your mobile telephone number — through our online application, contact form, the consent disclosure on our website, or during a verbal conversation with one of our representatives — and consent to receive text messages, here is how the First Class Capital SMS program works.

Program Purpose

First Class Capital may text you to: respond to inquiries you have submitted; deliver application status, document requests, e-signature links, and funding notifications related to your application or account; remind you of upcoming or missed payments; share servicing notices; and occasionally send service updates, refinance offers, and educational content related to small-business funding. Messages are sent only after you have provided your mobile number to First Class Capital directly or through one of our authorized lead-generation partners with disclosed consent to be contacted.

Consent is Not a Condition of Any Service

You are not required to agree to receive text messages in order to apply for, obtain, or maintain any product or service from First Class Capital. You may withdraw consent at any time using the methods described below.

Message Frequency

Message frequency varies based on your interactions with us and the status of your application or account. You may receive several messages per week during active applications and fewer at other times. There is no fixed maximum.

Charges

We do not charge for messages. Your wireless carrier's standard message and data rates may apply. First Class Capital is not liable for any delayed or undelivered messages, which may result from carrier issues outside our control.

HELP — Getting Assistance

Reply HELP to any text from First Class Capital to receive contact information for support, or email ryan@firstclassbusinessgroup.com.

STOP — Opting Out

Reply STOP to any text from First Class Capital to unsubscribe from all further texts. You will receive one final confirmation message and then no further text messages will be sent to that mobile number from our SMS program. You may also opt out by emailing ryan@firstclassbusinessgroup.com with the subject line "Stop SMS." Note that even after opting out of marketing texts, we may still send you transactional or service messages — application status, e-signature links, payment notices, funding confirmations — that are necessary to deliver the services you requested.

Supported Carriers

Our SMS program supports all major U.S. wireless carriers, including AT&T, T-Mobile, Verizon, U.S. Cellular, and their resellers and MVNOs. Carriers are not liable for delayed or undelivered messages.

No Sharing for Third-Party Marketing

The mobile information you provide to First Class Capital for the SMS program will not be shared with third parties or affiliates for their own marketing or promotional purposes. Aggregator and service-provider sharing for the sole purpose of delivering messages on our behalf is permitted under this Policy.

15. TCPA Right to Contact and Express Consent

By submitting our online application, our contact form, or otherwise providing your telephone number to First Class Capital, you expressly consent and agree that First Class Capital — and parties acting on our behalf — may contact you at the telephone number(s) you provide using:

• Live calls and voicemail
• Pre-recorded or artificial-voice calls
• Automated dialing systems and SMS / MMS text messages
• Email

This consent applies even if the number you provide is on any state or federal Do Not Call list and is given for purposes including, but not limited to, processing your inquiry or application, providing the products and services you have requested, account servicing, payment reminders, fraud prevention, and marketing of additional First Class Capital products and services.

Consent is not a condition of any service or purchase. You do not have to agree to be contacted by automated means in order to engage First Class Capital, and you can withdraw consent at any time by replying STOP to a text message, by asking the agent on a live call to remove your number, or by emailing ryan@firstclassbusinessgroup.com.

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and First Class Business Group Inc. DBA First Class Capital ("First Class Capital," "we," "our," or "us"), a New York corporation located at 100 Crossways Park Drive West, Woodbury, NY 11797. By using our website, submitting an application, completing a contact form, or otherwise engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Services Offered

First Class Capital is an alternative business funding company that connects business owners with funding solutions including but not limited to:

• Business lines of credit
• Working capital advances
• Bridge financing
• Alternative funding solutions

Funding amounts range from $10,000 to $5,000,000 subject to underwriting approval. Nothing on this website constitutes an offer to lend. All funding is subject to credit approval, underwriting review, and execution of final funding agreements. Terms, rates, and availability vary by applicant and are not guaranteed.

3. Eligibility

Our services are available only to individuals who are at least 18 years of age and are authorized representatives or owners of a legitimate, active US-based business entity. By submitting an application, you represent and warrant that: (a) you are at least 18 years old; (b) you have the legal authority to bind the business entity on whose behalf you are applying; (c) all information you provide is truthful, accurate, and complete; and (d) your business is operating legally in the United States.

4. Application & Funding Process

Submitting an application does not guarantee funding approval. The application process requires:

• Completion of our 1-page application (delivered via Zoho Sign)
• Submission of the last 4 months of business bank statements
• Any additional documentation requested by our underwriting team

First Class Capital reserves the right to decline any application at its sole discretion without obligation to disclose the reason. Approval decisions are typically communicated within 3 business hours of receipt of a complete application package. Funded amounts and terms are determined solely by our underwriting process and may differ from amounts requested.

6. Express Written Consent to Contact

In compliance with the TCPA (47 U.S.C. § 227) and the FCC's 2024 amended rules requiring one-to-one consent, by submitting any form on this website or providing your contact information to First Class Capital, you provide your express written consent authorizing First Class Capital and its representatives to contact you using:

• Automated telephone dialing systems (ATDS)
• Pre-recorded or artificial voice messages
• SMS and MMS text messages
• Live telephone calls
• Email communications

This consent applies even if your number is listed on any state or federal Do Not Call registry. Consent may be revoked at any time by replying STOP to any text, requesting removal during a live call, or emailing ryan@firstclassbusinessgroup.com. Revoking consent does not affect the lawfulness of any processing carried out prior to revocation.

7. Electronic Communications

By using our services, you consent to receive communications from us electronically, including via email and SMS. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. Electronic signatures on funding documents and applications via Zoho Sign or similar platforms are legally binding to the same extent as wet signatures under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state law.

8. Disclaimer of Warranties

Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. First Class Capital does not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee that any application will be approved or that any particular funding amount will be offered.

9. Limitation of Liability

To the fullest extent permitted by applicable law, First Class Capital, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or in connection with your use of our services, even if advised of the possibility of such damages. Our total liability to you for any claims arising from these Terms or our services shall not exceed the amount of fees, if any, paid by you to First Class Capital in the three (3) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless First Class Capital and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any false or misleading information you provide in connection with an application.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall first be subject to good-faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

Class Action Waiver: You agree that any arbitration or proceeding shall be limited to the dispute between you and First Class Capital individually. To the fullest extent permitted by law, you waive the right to participate in a class action lawsuit or class-wide arbitration.

12. Changes to These Terms

First Class Capital reserves the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a revised effective date. Your continued use of our services after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
